The economic and administrative implications of implementing new water legislation mean that certain elements will be most efficiently implemented through a phased process according to the social, economic and technical circumstances prevailing in each water region/catchment. Specific mechanisms will be required for a smooth transition from the present system to the new.

Government of Assam had prepared a draft state water policy in 2008, with support of the Assam Science Technology & Environment Council. The Rural Volunteers Centre, Akajan, an organization working in the water sector in Assam since 1993, had prepared this document outlining its concerns on the proposed state water policy based on its involvement, studies and observation.

Our initiative is supported by the Ministry of Water Resources, UNESCO, International Water Management Institute, and Water Technology Centre, (IARI), KPMG (as knowledge partner) and other prominent organizations in water sector. As is evident, Water is going to be of increasing critical importance to countries like India in the coming years. ASSOCHAM has been carrying out special studies and surveys on water conservation and related issues. Our view is that water is going to be as integral part of whole infrastructure system as roads, power, etc in the development process in future. During informal consultations with government officials, experts and NGO's, we have been advised to raise awareness about water management among the consumers, industrial houses, agriculturists, environmentalists, NGO's, media, etc. so as to generate priority concern for all and to help find right solutions.

Realising the necessity and urgency to provide sustainability to ground water resources in the critical areas of the country, Central Ground Water Board prepared a "Master Plan for Artificial Recharge to Ground Water" in 2002, for different States and Union Territories of the country.

The act aims to manage, control and regulate indiscriminate extraction of groundwater in West Bengal and to provide against its widespread contamination with arsenic, fluoride,  chloride, iron, other heavy metals or metalloids, organic and inorganic pesticides, fungicides, and rodenticides. It provides for the setting up of a State Level Authority which shall be under the administrative control of the Water Investigation and Development Department, Government of West Bengal and shall be the apex body of all the District Level Authorities and the Corporation Level Authority.

The Uttar Pradesh Water Management and Regulatory Commission Bill, 2008 aims to provide for the establishment of the Uttar Pradesh Water Management and Regulatory Commission to regulate water resources within the State, facilitate and ensure judicious, equitable and sustainable management, allocation and optimal utilization of water resources for environmentally, economically sustainable development of the State, fix the rates for water use for agriculture, industrial, drinking, power and other purposes and cess on lands benefited by flood protection and drainage works from the owners of lands benefited through appropriate regulatory instruments according to State Water Policy.

Some of the changes proposed are as follows –

• In section 4 of the principal Act, in sub-section (1), for clauses (a) and (b), the following clauses shall be substituted, namely:-
• the number of wells that were in existence in the scheduled area immediately before the date of commencement of this Act;
• the use of groundwater in the scheduled area for agricultural purposes immediately before the date of commencement of this Act;
• the number of wells from which water is extracted for domestic purposes;
• the number of wells from which water is extracted for industries, automobile service centres, multipurpose halls and other commercial centres;
• the number of water sources both public and private;
  • In sub-section (2), for item (vii), the following items shall be substituted namely:-
  • the details of the methods  adopted for groundwater conservation and rain water harvesting;
  • the quality of water with scientific evidence;
  • such other matter as may be prescribed.
